


Below is a copy of all the policies you are prompted to agree to prior to registering your self or your child up for any E5 program. Please review at your leisure.
Billing Authorization
I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card or bank account draft (ACH Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.
I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my ACH draft, or credit card account. I understand that a 30 day written notice is required to terminate billing and I am responsible for payment whether or not my student attends classes until I notify this facility in writing to drop my student from class(es).
Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.
Private Lessons
CANCELLATION/RESCHEDULING POLICY
Appointments can be canceled or rescheduled with no penalty up to 48 hours before the scheduled Appointment time. Canceling or rescheduling an appointment after that time may result in a cancellation fee being charged for the original Appointment booking.
GROUP APPOINTMENT POLICY
This facility allows a single student to book a individual Private Lesson timeslot. Any fees for this Private Lesson booking will be the sole responsibility of the student who booked the Private Lesson. This facility's staff will not be responsible for "splitting" the Appointment fee among multiple accounts. Any "split fee" arrangements will need to be handled externally by the families involved.
WHAT TO WEAR
Boys or Girls may wear tucked-in T-shirts and shorts OR Leotards for Girls. NO chewing gum or dangling jewelry. Hair should be pulled neatly and securely away from the face so that is stays up for the entire workout. Girls should not wear bows or other large hair ornaments that may cause discomfort during activity. All students should have activity-appropriate footwear during his/her scheduled Private Lesson time. Personal items should be left in cubby holes. Jewelry should not be worn during this time. PLEASE LEAVE JEWELRY ARTICLES AT HOME. This facility's staff will not be responsible for ANY items that may be lost or stolen. Be sure your student's personal items are marked with their name.
ARRIVAL AND PICKUP
Be sure your student arrives 5-15 minutes before (no earlier please) his/her scheduled Private Lesson time. Please pick up your student on time. Please inform us if you know you will be late picking up your student. Instruct your student to wait inside the building and you should escort them from the building to your car. During peak times the parking lot is crowded. Please take into consideration that our students may include young children. Please drive slowly and carefully. Do not take a chance on your student running to and from your car.
Rules, Terms, and Conditions
MAKEUP POLICY
Because of our strict student to teacher ratio, missed classes will not result in prorated tuition or refunds. Students are welcome to attend a make up class. Once a student is marked absent a make up token will automatically be issued to his/her account. There is no expiration date to the make up token. No refunds for classes missed including scheduled holidays as there will be an automated planned prorate for tuition during scheduled gym closures.
DROP PROCEDURE:
PARENTS MUST NOTIFY THE SCHOOL TO DROP A STUDENT FROM CLASS. Only a written notice via email.
Please note: You are responsible for payment for your student's classes WHETHER OR NOT YOUR STUDENT ATTENDS CLASS until the time you notify the staff VIA WRITTEN NOTICE THROUGH EMAIL. Please do not rely on your student to verbally let us know that he/she will no longer be attending classes. If a student stops coming to class without notification then that student's account will be charged for the additional 30 days. This charge will be for holding the student's place in that class instead of offering that place to one of the many on a waiting list.

Waiver of Liability
As the legal guardian of the student(s) named below ("Student(s)"), I hereby acknowledge and agree to the following on behalf of myself, my Student(s), and our respective heirs, assigns, and representatives:
1. Participation Consent
I consent to my Student(s) participating in activities at Elemental 5, including but not limited to:
tumbling, trampoline, acrobatics, ninja warrior-style training, parkour, aerial arts, martial arts, fitness instruction, stunt work, dance, juggling, tricking, participating in any inflatable structures owned by Elemental 5, and physical conditioning.
2. Acknowledgement of Risk
I understand and acknowledge that participation in these activities involves inherent risks of injury, including serious injuries such as fractures, sprains, paralysis, or even death, despite safety measures in place.
3. Assumption of Risk
I voluntarily assume all risks associated with participation for myself and my Student(s), including but not limited to physical injury, death, property damage, or emotional distress.
4. Release of Liability
In consideration of participation, I hereby fully and forever release, discharge, and hold harmless Elemental 5 LLC, its owners, officers, employees, contractors, sponsors, landlords, and agents from
any and all claims arising out of participation, including claims of negligence.
5. Medical Authorization
I authorize Elemental 5 staff to seek emergency medical treatment for my Student(s) if necessary
Elemental 5 Liability Waiver and Assumption of Risk
and agree to be financially responsible for any resulting costs.
I certify that I have read this waiver carefully, understand its contents, and sign it voluntarily.
Media Waiver
As the legal guardian of the student(s) named below ("Student(s)"), I grant permission to Elemental 5 LLC to photograph, video record, and otherwise capture images and recordings of my Student(s)
during participation at the facility, at an Elemental 5 sanctioned event, or any community event the student is participating in as a member of Elemental 5.
I understand that such media may be used for promotional purposes, including but not limited to social media, websites, brochures, posters, advertisements, and internal educational material.
By signing below, I release Elemental 5 from any claims related to the use of media as described.
I certify that I have read this release carefully, understand its contents, and sign it voluntarily.
Security Cameras in E5 Facility
I acknowledge that Elemental 5 utilizes security cameras throughout the facility for the purpose of maintaining a safe and secure environment. I understand that footage from these
cameras is primarily for security purposes and is not distributed publicly.
By signing below, I release Elemental 5 from any claims related to the use of security cameras as described.
I certify that I have read this release carefully, understand its contents, and sign it voluntarily.
One Time Payment Disclosure
By providing my credit card, debit card, or bank account information, I authorize Elemental 5 to charge my account for the agreed upon purchases and/or services.
If Elemental 5 is unable to secure funds from my credit/debit card(s) or my bank for any reason, including, but not limited to, insufficient funds in my credit/debit card or bank account or insufficient or inaccurate information provided by me when submitting my electronic payment, Elemental 5 may undertake further collection action.
Recurring Payments Policy
By providing your debit card, credit card, or bank account information and opting in to recurring payments, you certify that you have the authority to authorize debits or charges to the payment information identified here and you authorize Elemental 5 to electronically debit or charge the payment information on a recurring basis in the amount due on or after the due date for your payment.
Your authorization will remain in effect until you notify us that you wish to revoke this authorization and we have a reasonable opportunity to act on your notice. You may opt out of recurring billing by accessing your account online at elementalfive.com or on your device by using The iClassPro app. You may print this authorization or store it electronically and keep it for your records.
Returns, Refunds, and Cancellations Policy
All sales are final. Because classes have limited openings and are reserved for as long as you are enrolled, there are no refunds for any classes missed. If you have opted in for automatic payments, your authorization will remain in effect until you notify us that you wish to revoke this authorization and we have a reasonable opportunity to act on your notice. Based on the circumstances that may apply to a specific situation, funds may be transferrable to other services/goods Elemental 5 offers.
Other Policies You Should Know
Camp Friday Registration Policy: In order for this program to make fiscal and practical sense there needs to be at least 6 students signed up for the program.​

To help the assigned coach better prepare, we ask that you sign your child up for the program at least by 9PM the day before (Thursday).

If by 9PM on Thursday there are not at least 6 students signed up for the program the
following day, then we will unfortunately have to cancel the Camp Friday for that day. If
you do not receive any notification then the Camp Friday session is still scheduled to run.
Any payment for tuition put forth for that specific date will be reissued to each family’s account as a credit to be used for future services/goods that E5 has to offer. Knowing who plans to join the program for that week and how many students we will have helps the assigned coach better mentally prepare with age appropriate games and lessons.
Families are still welcome to do day-of drop-ins, however, the program is only guaranteed to run if there are at least 6 students registered by the end of the prior day.
​New Billing Day: All monthly billing is processed the 1st business day of each month

Enrollment Cancelation: Cancelation requests must be submitted 7 days prior to the new billing period to ensure there is plenty of time to process cancellations prior to billing being run.
No Refunds: There will be no refunds or prorated tuition for missed classes, or failure to request a tuition/event cancelation prior to billing day. All funds are transferrable to other services/goods Elemental 5 offers.
Gym Closure Proration: tuition will be prorated for planned gym closures and if a student enrolls in a class partway through the month. Tuition is not prorated for missed classes.
New Makeup Policy: If a student misses class whether planned or unexpected, then they are still able to make up that class. Once the student is marked 'absent' for their class then a 'Makeup Token' will be applied to their account. Parents will be able to schedule makeup classes using the token through their online customer portal. Parents may schedule a makeup class within 14 days of today's date. The token do not expire. Makeup classes may still be scheduled between different programs. UPDATE: Make up tokens are only eligible to use if a student is currently registered in classes or is scheduled to start a class in the future. Make up tokens are only eligible to the same skill level/time duration class equal to or less than the class they missed. For example: a Makeup token for Ninfit lvl 1-3 class is eligible for a Beginner Tx3 class, but not a Ninfit lvl 4+ class because the skill level is higher and the duration of the class is 90 minutes, as opposed to Ninfit lvl 1-3 which is 60 minutes. HOWEVER, a makeup token for a Ninfit lvl 4+ can be used for a Ninfit lvl 1-3 class or a Beginner Tx3 class, because the shorter class duration still falls within the 90 minutes class duration.
Punch Passes: Punch passes may be shared among family members however they may no longer be extended to friends/members outside of the registered family unit.
Birthday Parties: It is not required for clients to call prior to booking a birthday party. It may all be done through the online customer portal. There are specific designated time slots to choose from, still with the option of purchasing an extra half hour. If you are looking to book a party on a Sunday then you will need to contact the front desk for availability. Please note that if a client requests an extra half hour they will be expected to pay that added fee the day they book their event and process their deposit. Any extra guest fees will be processed the day of the party at the end. You will be able to book a party no earlier than 2 weeks in advanced. If you are looking to book an event less than 2 weeks in advanced then you will need to contact the front desk.
